About

Sara Parolari is Senior Researcher at the Institute for Comparative Federalism of Eurac research. She has been visiting scholar at the Faculty of Law of the University of Cambridge and the University of Edinburgh. She got her PhD in Comparative and European Legal Studies at the University of Trento in March 2007.

Her main research interests are Italian regionalism with a focus on special Regions, the special status of Trentino-Alto Adige/Südtirol, Federal and Regional Studies, Crossborder cooperation, and devolution in the British legal system.

She authored several articles on these topics in academic journals as well as edited books. She had provided consultancies to the Council of Europe and to regional/provincial governments in Italy.

Il volume offre i risultati di un primo tentativo di sistematizzare e mettere in rete la conoscenza accumulata dai Gruppi Europei di Cooperazione Territoriale (GECT) con partecipanti italiani, a 20 anni dall’approvazione del regolamento europeo 1082/2006 che ha istituito questo strumento. I GECT sono organismi con personalità giuridica definiti dal diritto dell'Unione europea, finalizzati a programmare e gestire attività di cooperazione transfrontaliera e transnazionale. Il lavoro di ricerca, condotto da un team multidisciplinare (diritto, geografia, pianificazione del territorio), restituisce la fotografia di uno strumento dinamico e in evoluzione, che ha consentito sinora di raggiungere risultati molto significativi e, al tempo stesso, sembra non aver ancora raggiunto appieno lo sfruttamento del suo potenziale. Da questo punto di vista, il volume offre anche una serie di spunti per ulteriori approfondimenti e attività, in cui ricerca e accompagnamento possano sostenere l’efficacia e l’utilità delle azioni di cooperazione territoriale europea.

The role of Italian Local Authorities in Conferences with Other Government Levels

This chapter focuses on the intergovernmental relations between local authorities, Regions and the State in Italy. It provides an overview of intergovernmental relations involving local authorities and assess their impact on national and regional policy-making. The chapter describes Italy’s local governance system and discusses the importance of collaboration mechanisms between local authorities and higher levels of government, highlighting the lack of parliamentary representation for municipalities and formal forms of collaboration with the municipalities at national and regional level. The chapter shows that there have been no significant legal changes in formal relations at the national level in recent years. However, local actors’ political influence has grown in practice, even if it is fragile due to its dependence on leaders’ abilities and terms.

Die digitale Transformation schreitet weltweit mit wachsender Geschwindigkeit voran und hat alle Lebensbereiche der Bürger:innen längst erfasst. Welchen Einfluss hat dies auf die Gesetzgebungs- und Verwaltungskompetenzen von Bundesländern oder Regionen? Eine der brennendsten Fragen lautet, ob in Staaten mit föderalen oder regionalen Strukturen zwangsläufig eine Zentralisierung von Kompetenzen stattfindet. Können autonome Handlungsspielräume der Gliedstaaten behauptet werden oder tritt zwangsläufig eine Zentralisierung der Zuständigkeit ein? Neben einer allgemeinen rechtlichen Einordnung des digitalen Wandels und seiner Herausforderungen zeigen die Fallbeispiele Italien, Autonome Provinz Trient, Autonome Provinz Bozen-Südtirol, Österreich, das Bundesland Tirol, Deutschland und Estland interessante Instrumente und Methoden, um die Autonomie im Rahmen des globalen Digitalisierungsprozesses zu erhalten, anzupassen und weiter auszubauen.

Digital transformation is accelerating around the world and has already penetrated every aspect of citizens' lives. What are the implications for the legislative and administrative powers of federal states or regions? One of the most pressing questions is whether there is an inevitable centralisation of powers in states with federal or regional structures. Can the autonomous decision-making powers of the constituent states be maintained, or does a centralisation of powers inevitably take place? In addition to a general legal classification of digital change and its challenges, case studies from Italy (Autonomous Province of Trento, Autonomous Province of South Tyrol), Austria (Tyrol), Germany and Estonia present interesting tools and methods for preserving, adapting and extending autonomy in the context of the global digitalisation process.

L’ordinamento giuridico britannico, caratterizzato da una devolution asimmetrica,
richiede meccanismi di coordinamento idonei a gestire i rapporti tra governo centrale e governi
devoluti. Questo contributo esplora l’evoluzione, le sfide e le recenti riforme delle relazioni
intergovernative (IGRs) all’interno del Regno Unito, concentrandosi sulla transizione da forme
di raccordo tradizionalmente informali ad una maggiore istituzionalizzazione avvenuta a seguito
di una riforma introdotta nel 2022, valutandone la sua complessiva efficacia nella gestione della
cooperazione intergovernativa e nella risoluzione dei conflitti.

La tutela della salute in Alto Adige/Südtirol: una fotografia del Servizio Sanitario Provinciale

The article provides an in-depth analysis of the health system in South Tyrol. It discusses the legislative framework, the organization of the provincial health service, and the financial aspects. The article highlights the unique structure of this health system, covers the provincial health planning, the relationship between public and private healthcare, waiting times, as well as patient mobility for hospital admission. All in all, this snapshot of the South Tyrolean health system clearly shows that it does not exhibit significant critical issues. The financial situation is solid, and the system meets the health needs of the citizens. However, there are still areas for improvement, related to the waiting lists and the percentage achievement of the Essential Levels of Care.

Il presente volume si concentra sul tema della cooperazione transfrontaliera in ambito sanitario prendendo le mosse dall’analisi del quadro giuridico europeo in materia di sanità per poi dedicare particolare attenzione alle ricadute su uno specifico territorio: quello dell’Euregio che interessa l’area del Brennero al confine tra Italia e Austria.

I contributi approfondiscono la politica sanitaria dell’Unione Europea e la sua gestione della crisi sanitaria, nonché gli effetti sulla rispettiva politica italiana. Alla luce del contesto così descritto, il volume passa a concentrarsi sull’area ove opera il GECT Euregio Tirolo-Alto Adige-Trentino e che, dal punto di vista istituzionale, interessa le Province autonome di Trento e Bolzano (in Italia) e il Land Tirolo (in Austria).

Ciò al fine di comprendere e valutare i risultati raggiunti sinora in termini di cooperazione transfrontaliera sanitaria in questo territorio, gli eventuali ostacoli e limiti imposti dal livello europeo e nazionale, nonché i futuri scenari possibili.

The selected case studies of the Autonomous Provinces of Bolzano/Bozen and Trento, in Italy, and the Länder Tyrol and Vorarlberg, in Austria, are geographically close and hence confronted with similar challenges on climate change action in multi-level governance systems. This circumstance may lead to different solutions or shared approaches to common problems, as regions act in the framework of their competencies and policies, and also justifies cooperation to develop coordinated approaches amongst Alpine countries.

Il presente volume fa il punto delle più recenti esperienze di decentramento in Europa, da un lato, attraverso l’analisi comparata di alcuni Stati composti, dall’altro, dedicando particolare attenzione al caso italiano. Quello del decentramento negli Stati composti e della capacità di questi ultimi di adattarsi per affrontare i cambiamenti è un argomento particolarmente attuale, soprattutto se si considera quanto gli ordinamenti decentrati sono stati segnati dall’emergenza pandemica. Ad una prima parte in cui vengono analizzate da una prospettiva comparata le più recenti tendenze del decentramento emerse nel contesto europeo, fanno seguito una serie di contributi che si soffermano su una selezione di specifici profili di analisi: dai rapporti intergovernativi nell’ambito della gestione della governance ambientale, ai più recenti sviluppi del decentramento fiscale, dalle relazioni intergovernative tra Stato e Regioni, all’assetto delle autonomie locali in Italia dalla prospettiva delle aree urbane. L’intento è quello di comprendere le evoluzioni sul fronte delle dinamiche intergovernative, per determinare se nella gestione delle politiche pubbliche gli Stati composti europei all’esame si facciano effettivamente promotori di un decentramento attraverso la cooperazione dei livelli di governo o se, all’opposto, risulti prevalente il conflitto tra gli stessi.
